International Construction Projects

The International Construction Projects Committee has approximately 240 members. The current chair is Mohan Reviendran Pillay (Singapore) and vice chairs are Philip Trevor Nunn (Hong Kong) and Ivan Y. F. Loo (Kuala Lumpur).

The Committee will be organizing 2 Programs for the Los Angeles Annual Conference 2008 (27-30 April, 2008) as follows:

Expediting the Dispute Resolution Process in Major Construction Projects (Joint panel with the Dispute Resolution and Arbitration Committee)
This panel will delve into a critical examination of different models for expeditiously resolving major construction disputes, analyzing how they work on a practical level as well as their prospects for success. Join us for an in-depth review of models like statutory adjudication, DRBs/DABs, expert determination, and the 100-day arbitration model.

Large-Scale Railway Projects: Mitigating the Risks (Stand-alone panel)
This session will explore risk management strategies for the construction and operation of mass transit and high-speed rail systems, both within cities and between them. Panelists will assess issues affecting rail investment and development, upgrading vs. the greenfield approach, project procurement and delivery models, risk analysis and allocation, and project management from the employer/government perspective. From the contractor’s perspective, panelists will explore preferred project procurement and delivery models, managing risks, dispute resolution models, and operations vs. construction issues.

Each year the committee considers various aspects of construction law which are of practical interest to practitioners. At Beijing Conference, speakers considered trends in the allocation of risk in international construction contracts and in particular:

  • how risk is allocated
  • the impact of government policy
  • the consequences of "unfair" allocation
  • problems with pricing unquantifiable risk.

At Seoul Conference, speakers looked at public/private partnership ("PPP") arrangements, which are the subject of much interest in the region, and in previous years we have considered the FIDIC forms of contract as well as energy projects in developing countries.

The aim of the international construction projects committee is to foster a collegiate spirit among practitioners of international construction law. Major infrastructure projects often bring together contractors, other construction professionals and financiers (and their legal advisers) from a variety of jurisdictions who have different experiences of undertaking projects, different expectations of how the project and its documentation will be put together and different commercial expectations. Our committee provides a forum for discussing the management of the differences, a means of providing updates on new laws and contracts and emerging trends in the construction industry.
