Intellectual Property

The objectives of the Intellectual Property Committee are to:

  1. share and exchange ideas or information amongst the practitioners on Intellectual Property Law and its application and enforcement;

  2. participate in meetings and conferences held by the Association to achieve objective (1) above; and get acquainted with other members of the same profession.

2007 IPBA BEIJING ANNUAL CONFERENCE UPDATE

Committee Program Topic: "IP Enforcement In and From China"

  1. 1. IP Enforcement in China: what is going on?
    • mainly for Trademark and Copyright
    • by prosecuting agency, border control/custom measures authorities, arbitrators and courts
    • International IP Enforcement in China (Treaties), (GATT TRIPS, international Treaties and international comity)
  2. 2. IP Enforcement from China: what are the issues?
    • discovery/disclosure obligations
    • retention of documents
    • discovery and depositions in China or litigation abroad
    • collecting evidence in China for international litigation

Synopsis: This session will cover IP enforcement

"In China" mainly for foreign lawyers concerning their clients' protection of IP rights in China and "From China" mainly for Chinese lawyers concerning the IP rights of Chinese companies in the other jurisdiction.

For the topic of "In China," the speaker hopefully from Chinese government sector handling IP law enforcement is expected to cover generally status of enforcement and efforts on the way. The panels (foreign lawyers will discuss experiences and how to make better procedure for enforcement.

The other topic of "From China" will begin with two speakers from US and EU and Q&A with the floor will follow. This is intended to show how IP right of Chinese right holders should be maintained to be fully accepted in other jurisdiction.
